The Office of the Attorney General is committed to protecting citizens and upholding the rule of law. As such, Attorney General Bird has advocated for increased penalties for the distribution of drugs that lead to death. In 2023, the Iowa legislature passed, and Governor Kim Reynolds signed into a law a bill proposed by Attorney General Bird that increased penalties for drug users and dealers.
50 Years in prison for individuals found guilty of possessing or distributing substances of more than 50 grams containing fentanyl.
25 Years involving between 5-50 grams of substances containing fentanyl.
10 Years involving 5 grams or less of substances containing fentanyl.
The law also tripled those sentences when a dealer gives someone that drug and it kills them. Previously, if a drug dealer gave someone fentanyl, and they died, Iowa did not have an adequate law to address it. The new law increased the punishment if an individual is severely injured, or if a minor is involved.
