Judge Penalizes Washington, Iowa Companyfor "One Call" Violation

(DES MOINES, Iowa)  Washington County District Court Judge Dan F. Morrison has assessed a $7,000 civil penalty against Miller Welding & Tiling, Inc., d/b/a G & R Construction, of Washington, Iowa, for violations of Iowa’s One Call (“Call before you dig”) statute.  In a decree filed Friday, Judge Morrison also enjoined the defendant from further violations.

The petition, filed Friday by Attorney General Tom Miller, alleged that on October 28, 2009, Miller Welding conducted excavations without providing notice and having underground facilities located and marked.  While using a tiling machine to install drainage tile in rural Washington County, Miller Welding’s equipment hit and damaged a 36-inch diameter natural gas pipeline and came to within one foot of another 36-inch diameter natural gas pipeline, both of which were under 629 pounds per square inch of pressure.  Miller Welding then notified the pipeline owner of the damage which repaired the pipeline.

Miller Welding admitted the violations, consented to entry of the decree, and has paid the penalty.
