Judge Penalizes Kossuth County Companies and Owners for Failing to Submit Manure Management Plans

(ALGONA, Iowa)  Kossuth County District Court Judge Nancy L. Whittenburg Wednesday penalized two north central Iowa companies and their principal owners $40,000 for failing to timely submit manure management plans to the Iowa Department of Natural Resources at eight confinement feeding operations located in Kossuth and Palo Alto Counties.

The order resolves a lawsuit previously filed by Attorney General Miller against General Development, L.C., and Kollasch Land and Livestock, Inc.  General Development is located in Algona, and Kollasch Land and Livestock is based in Whittemore.  Brothers Luke and Charles Kollasch, both of Algona, are principals of both companies.

Manure management plans, including a phosphorus index, are required in order to show that operations have adequate land for application of manure produced by the animals at the confinement feeding operations.  Both defendants have now completed the required manure management plans.
The judge also enjoined the defendants from further violations of the manure management plan requirements.
