Debt Collector Notification

Iowa does not license debt collectors. However, debt collectors who meet Iowa’s notification requirements must file notification with the Iowa Attorney General and pay the required annual fee.

Debt collectors who fail to file notification and pay the appropriate fee may be subject to a $75 late fee, as well as possible civil action to recover interest, costs, and penalties.

Who Files

Who needs to file notification?

Debt collectors who meet both of the following criteria must file notification with the Office of the Attorney General and pay the annual fee.

1. Collect consumer debts from Iowans

The definition of consumer debt under Iowa law is broad and includes a variety of debts other than consumer credit transactions.

  • Dishonored checks
  • Medical bills
  • Accounts based on “90 days same-as-cash”
  • Typical accounts receivable billings for consumer purposes
  • Debts incurred for personal, family, or household purposes where credit was extended

2. Collect over $73,400 in total debts

Debt collectors must file if they collect over $73,400 in total debts in the previous or current calendar year, based on the aggregate amount collected from all sources, not just Iowa accounts.

Example: A debt collector collected $74,000 in debts last year, but only $5,000 was from Iowa debtors. This debt collector would still be required to file notification.

Creditors collecting their own debts

Most creditors collecting their own debts are not required to file notification as debt collectors, but they must comply with the substantive requirements of the Iowa Debt Collection Practices Act.

Attorneys acting as debt collectors

Attorneys who act as debt collectors are required to file notification. Law firms whose attorneys act as debt collectors and collect over $73,400 a year must file notification.

Companies that solely collect commercial debt are exempt from filing notification with the Office of the Attorney General.

How to File

Choose a filing method

Debt collectors required to file notification must do so within 30 days of commencing collection activities in Iowa, and then by January 31 of every subsequent year.

File Online

Complete the notification form online and pay the annual $50 notification fee through the website.

Payment notice: Online payment requires bank account information for ACH auto-debit. A $1.00 convenience fee applies. Credit card payment is not currently available.

Printable Form

Print the form, complete it by hand, and mail it with a $50 check made payable to Iowa Consumer Credit Administration Fund.

After You File

What happens after notification is filed?

Collectors who file notification with the Office of the Attorney General will not receive a confirmation, notice, or hard copy license.

Approved notifications will be processed and can be viewed online approximately 20 business days after receipt. Some users may need to refresh their browser for the most updated version of the document.

View Registered Entities

A notification will be rejected if the company’s principal office is located outside Iowa and an Iowa Registered Agent is not listed on the registration form. The registered agent must be located in Iowa and must not be the Iowa Secretary of State.

Iowa Code 537.6202(1)(f)

Collectors should notify the Attorney General in writing of changes to company contact information. Updates should include the company name, previous incorrect information, and updated current information.

There is no fee associated with these changes.

Email Registration Staff

Reminders will be sent via the email on file in December. Failure to receive reminders will not exempt a late filing from the $75 late fee.
